  1. Administrative Penalties, Amelioration, and Informal Dispute Resolution for Home and Community-based Services (HCS) and Texas Home Living (TxHmL) Programs

The Texas Health and Human Services Commission (HHSC) proposes amendments, new sections, and repeals to Texas Administrative Code (TAC) Title 40, Part 1, Chapter 9, Intellectual Disability Services--Medicaid State Operating Agency Responsibilities, and Chapter 49, Contracting for Community Services. The purpose of the proposed rules is to implement Texas Human Resources Code §§161.089, 161.0891, and 161.0892 added by House Bill 2590, 85th Legislature, Regular Session, 2017.

  1. Disproportionate Share Hospital (DSH) Program Unspent Funds and Hospital-Specific Limit (HSL)

HHSC proposes amendments to TAC Title 1, Part 15, Chapter 355, Subchapter J, Division 4, §355.8065, concerning DSH Reimbursement Methodology, and §355.8066, concerning HSL Methodology. The amendments will add language to the rules relating to methodology that HHSC will use to pay the unspent funds available for program years 2014 - 2017 DSH, and for the calculation of the HSL for these retrospective and prospective DSH payments.

  1. Inpatient Direct Graduate Medical Education (GME) Reimbursement

HHSC proposes an amendment to TAC Title 1, Part 15, Chapter 355, Subchapter J, Division 4, §355.8058, concerning Inpatient GME Reimbursement. The proposed amendment will allow teaching hospitals owned or operated by non-governmental entities to receive Medicaid GME supplemental payments, provided that the non-federal share is provided by a local governmental entity.
